A panel discussion intended intended to foster discussion on several debates relating to environmental regulation and investor expectations under NAFTA Chapter 11. Panelists will address:

* Issues surrounding the increasing use of the precautionary principle and its potential impact on investor rights and investment flows;
* how the concept of science-based decision-making and public consultation relates to minimum standard of treatment (due process) rights under NAFTA; and
* the evolving debate in distinguishing legitimate regulation from compensable expropriation.
